ABI Editor-at-Large Bill Rochelle discusses the Supreme Court's May 26 opinion in Margolin v. National Association of Immigration Judges with Prof. Bruce Markell of the Northwestern University Pritzker School of Law. The Court held that the Fourth Circuit had violated the “party presentation principle” by reversing and remanding “based on an issue the parties had not raised.”  Rochelle talks with Markell about how the Margolin decision may create tension with the Court's previous ruling in Espinosa and how it may impact bankruptcy practice.

ABI Editor-at-Large Bill Rochelle discusses the Supreme Court's June 11 opinion in Keathley v. Buddy Ayres Construction with Prof. Robert Lawless of the University of Illinois College of Law. In determining whether an omission of a claim in the bankruptcy context was inadvertent or mistaken for purposes of the judicial estoppel doctrine, the Supreme Court held unanimously that courts should look to the totality of the circumstances surrounding the omission.
